MINEOLA, N.Y. (AP) - Where there are shellfish, expect shells.

That was the ruling from a New York judge, who recently dismissed a claim by a woman who sued a restaurant for $750,000 US after choking on a piece of mussel shell.

Mary Slaymaker said she suffered a punctured throat and an infection after choking on a 2.5-centimetre piece of shell during a meal of mussels marinara at the Blue Moon Restaurant.

But state Judge John Galasso dismissed the lawsuit, saying Slaymaker should have had a "reasonable expectation" that a dish containing mussels could have shells in it. He also said she failed to prove the dish was "defective."

What kills me are not the inane things people try to sue everyone over these days (ludicrous enough), but that most of the incidents are self-induced, usually by sheer stupidity. They must think judges are complete idiots.

Thats entirely too true, Dee. Add into the mix far too many ambulance chasing lawyers and this is the result. Folks suing for things that should be chalked up to their own stupidity... People suing mcdonalds because they are overweight.. People suing chrysler because they didn't tighten their lugnuts properly.. Gee, I cut my finger off with this bandsaw..its gotta be Black and Deckers fault.

We don't need more lawsuits or lawyers.. what we need is a good old fashioned axe handle butt-whoopin on the next knucklehead that pushes a stupid lawsuit.
