"In SONY BMG v. Merchant, in California, the defendant's lawyer wrote the RIAA a rather stern letter (http://p2pnet.net/story/11785) recounting how weak the RIAA's evidence is, referring to the deposition of the RIAA's expert witness (http://www.ilrweb.com/viewILRPDF.asp?filename=umg_lindor_070223JacobsonD epositionTranscript) (see Slashdot commentary (http://yro.slashdot.org/yro/07/03/03/237211.shtml?tid=185)), and threatening a malicious prosecution lawsuit.
